These Terms of Service ("Terms") govern your access to and use of the website and services provided by Digital Nebraska ("we," "us," or "our") at digitalnebraska.com. By using our website or engaging our services, you agree to these Terms. Please read them carefully.

1. Our services

Digital Nebraska provides an inbound AI phone agent and related services, including 24/7 call answering, intelligent call routing and transfer, caller qualification and intake, appointment booking, and message capture with handoff to your team and systems. The specific scope, deliverables, and fees for any engagement are set out in a separate agreement or order between us and the client. These Terms govern general use of this website; a signed service agreement, where one exists, controls the paid services.

We also offer Website Launch, standalone Digital Back Office, standalone AI Phone Agent service, the Website + Digital Back Office package, and a Website + Digital Back Office + AI Phone Agent bundle through the hosted checkout links shown on this website. The checkout page identifies the price and included first-year scope for the selected offer. A hosted checkout is an additional purchase path; you may still use our contact form to ask questions before purchasing.

Website Launch is a $995 upfront project that includes one page, mobile-friendly design, deployment, one year of hosting, and two consolidated revision rounds. The required onboarding intake includes business contact details, address and hours, core service or product descriptions, a high-resolution PNG or vector logo, and DNS or domain-registrar access. Work begins after all mandatory items are received. You may supply brand photography and copy, or Digital Nebraska may use licensed stock imagery and professionally structured standard copy based on your intake responses. Custom copywriting and original photography are not included. You retain domain ownership and control; access is used to connect the site. The project is non-refundable once onboarding is submitted and design commences. If you cancel before submitting assets, you receive a partial refund minus a $150 administrative setup fee. Requests beyond the included scope or revision rounds require a separate charge or agreement.

Each of the two included revision rounds means one consolidated punch-list submitted through the intake form or a markup link. Separate piecemeal emails or messages do not create additional rounds. For the customer's website, Website Launch does not include multi-page architecture (anchor links within the one page are allowed), e-commerce checkout, payment gateways or inventory setup, custom third-party API or database integrations, ongoing monthly SEO retainers, or advertising setup.

Website Launch hosting includes hosting service, automated daily backups, and SSL maintenance for the first 12 months. Renewal pricing is quoted at renewal; a site may be transferred elsewhere with at least 30 days' notice. Post-launch text swaps, image updates, and structural changes are not included in the launch scope.

Digital Back Office includes customer relationship management, email marketing, social post scheduling, booking calendar, forms creation, project management, knowledge base, and automations. The AI Phone Agent is native to the platform, but Digital Back Office alone does not include an active phone-service subscription. Phone-agent changes can be managed in the platform when the customer has an active phone subscription. The $1,995 Website + Digital Back Office package includes one year of the platform and up to three users from the start; additional users are $19 per month each. It renews after the included year at the then-current individual product pricing and terms, currently $99 per month for Digital Back Office.

Digital Back Office is also available standalone at $99 per month, month to month, for up to three users. There is no setup or onboarding fee. To begin, provide business information, an email address, and payment. A sales agent helps with initial setup. Standard support covers access and troubleshooting through the platform and email; additional questions may be sent by email. Potential metered charges, including text-message use, are separate. Access continues through the paid billing period. An export may be requested for up to 90 days after cancellation; data-retention or removal requests after that period are handled case by case.

The AI Phone Agent is a separate month-to-month service unless included in the complete first-year bundle. The $2,995 complete bundle includes one year of Website Launch, Digital Back Office for up to three users, and the standard AI Phone Agent service. After year one, each component follows its individual pricing and terms.

For new Digital Nebraska phone customers who start by December 31, 2026, the promotional rate is $129 per month and includes 500 inbound minutes and 500 SMS per month. Those qualifying customers keep the $129 monthly rate through December 31, 2027 while continuously active and in good standing. Cancellation, nonpayment, or reactivation ends that price lock. The standard comparison rate is $199 per month. A complete-bundle customer who qualifies under this promotion keeps the promotional phone rate after the included service year under these same continuous-service conditions. Digital Nebraska phone overages are $0.15 per minute and $0.03 per SMS. There is no setup or onboarding fee. The customer provides business information and guidance on how calls should be treated; a sales agent helps establish the initial call flow. Later changes can be made in the platform, with support available for additional assistance.

Cancel before the end of the current billing period to prevent renewal for the next period; phone service remains available through the paid period. Overage charges already incurred remain due. Refunds for prepaid monthly phone service are considered case by case.

2. Use of our website

You agree to use our website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of, this site by others. In particular, you agree not to:

• Submit false, misleading, or fraudulent information through our forms;
• Attempt to gain unauthorized access to our systems or interfere with the site's operation;
• Use automated means to scrape, harvest, or overload the site; or
• Use the site to transmit spam, malware, or unlawful content.

3. Contact submissions

When you submit an inquiry through our contact form, you confirm that the information you provide is accurate and that you are authorized to share it. We will use your submission as described in our Privacy Policy.

4. Text-message consent

Where a form presents a separate, voluntary text-message consent checkbox, checking that box and providing a mobile number is your express written consent for Digital Nebraska to send recurring automated promotional and personalized marketing text messages to that number. The consent applies only to Digital Nebraska.

Consent is not required to make a purchase, receive services, or submit an inquiry. Message and data rates may apply, and message frequency varies. You may withdraw consent by replying STOP to a text message, reply HELP for help, or contact us using the details below. We will honor valid revocation requests as required by applicable law. Providing a mobile number without checking the separate consent box does not authorize marketing texts.

The form submission and associated consent record are intended to document your selection. Additional service-specific terms may apply if you enroll in a separate messaging program.

5. Intellectual property

All content on this website — including text, graphics, logos, and design — is owned by or licensed to Digital Nebraska and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute our content without our prior written permission, except for your own internal, non-commercial reference.

6. Third-party links & services

Our website may contain links to third-party websites and services (such as our careers site, hosted payment processor, and analytics providers). We do not control and are not responsible for the content, policies, or practices of those third parties. Accessing them is at your own risk and subject to their terms and privacy notices. Payment information entered on a hosted checkout is handled by that payment provider under its applicable terms and privacy notice.

7. No warranties

Our website is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components. Any performance descriptions on this site reflect our service goals and are not guarantees of specific results.

8. Limitation of liability

To the fullest extent permitted by law, Digital Nebraska and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of, or inability to use, this website.

9. Indemnification

You agree to indemnify and hold harmless Digital Nebraska from any claims, damages, or expenses arising out of your misuse of the website or violation of these Terms.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the website after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Digital Nebraska operates, without regard to its conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there.
